Trial of alleged mercenaries to be heard tomorrow
Private Forces escribió:February 05, 2007 - The trial of eight alleged South African mercenaries implicated in an alleged plot to overthrow the government of Equatorial Guinea, has been postponed until tomorrow in the Pretoria Regional Court.

Tori Pretorius, a State advocate, says this is to give the state and defense an opportunity to hold a pre-trial conference and sort out further particulars.Mercenary accused to turn State witnessMeanwhile, the case against the ninth suspect has been withdrawn. Pretorius says he cannot confirm whether the suspect is turning State witness.

The men face charges of contravening regulations of the Foreign Military Assistance Act. They were part of a group of 61 South Africans released from Zimbabwe's Chikurubi prison in 2005 after serving 12-month sentences there for violating immigration, aviation, firearms and security laws.

Mercenary accused to turn state witness
Sap escribió:- 05 February 2007

CHARGES against one of the nine men accused of plotting to overthrow the government of Equatorial Guinea were dropped in the Pretoria Regional Court today.

Maitre Ruakuluka appeared briefly with his eight co-accused. The other eight are: Raymond Stanley Archer, Victor Dracula, Louis du Preez, Errol Harris, Mazanga Kashama, Neves Tomas Matias, Simon Morris Witherspoon and Hendrick Jacobus Hamman.

State Advocate Torie Pretorius withdrew the case against Ruakuluka, apparently because he was to turn State witness. "That is only a speculation, but it is fair speculation," Pretorius told reporters afterwards.

The eight others are charged with contravening the Regulation of Foreign Military Assistance Act. They were part of a group of 61 who returned to SA in 2005 after spending more than a year in a Zimbabwean prison for violating that country’s immigration, aviation, firearms and security laws.

The charges related to an alleged plot to topple Equatorial Guinea’s long-time dictator, President Teodoro Obiang Nguema. The men were among a group of 70 arrested in March 2004 when they landed at Harare International Airport, allegedly to refuel and pick up military equipment.

Zimbabwean authorities said they were on their way to join other suspected mercenaries arrested in Equatorial Guinea at about the same time. Their trial is set down for three weeks and Pretorius told the court that there are more than 100 State witnesses. They however asked for a postponement till tomorrow to see if they can not come to an agreement with the defence teams on certain aspects of the trial.

"I hope to call only a dozen or so witnesses," Pretorius told the court. He said that it depended on the defence teams. The trial continues tomorrow.

Mercenaries saga: E. Guinea seeks foiled coup leader’s extradition
Herald of Zimbawe escribió:Mann is serving a four-year jail term, and is due for release in May

Equatorial Guinea has applied to have Simon Francis Mann, who is in jail in Zimbabwe for leading a foiled coup against President Theodoro Obiang Nguema Mbasogo, extradited for trial in that country. Mann is serving a four-year jail term at Chikurubi Maximum Security Prison for contravening Zimbabwe’s firearms laws. He is due for release in May. Mann’s lawyer Mr Jonathan Samkange of Byron Venturas and Partners confirmed that the application by Equatorial Guinea would be heard on Thursday at the Harare Magistrates’ Court. He said the Government was not an interested party in the case. "The Government is neutral. It has no interest whatsoever whether he is extradited or not. All they can do is try to assist Equatorial Guinea by providing a magistrate and lawyers and they will simply present the Equatorial Guinea’s position," said Mr Samkange. Harare magistrate Ms Omega Mugumbate is expected to preside over the application, while Mr Joseph Jagada of the Attorney-General’s Office will make the presentation of Equatorial Guinea’s position.

Mann and his other 61 accomplices were arrested in February 2004 when they made a stopover at the Harare International Airport to pick up weapons en-route to Equatorial Guinea to stage a coup against President Nguema’s government. The mercenaries - who were of different nationalities but all travelling on South African passports - were found guilty of breaking Zimbabwe’s aviation and firearms laws. They are believed to have been hired by exiled Equatorial Guinea opposition leader, Mr Severo Moto, to topple President Nguema’s government. One mercenary died while serving his prison term in 2004 and two others, after being diagnosed as seriously ill, had their sentences slashed to time served through routine presidential clemency orders and were released and immediately deported to South Africa. The ringleader, Mann, a former member of the British Army’s Special Air Service commando unit, pleaded guilty to contravening the Public Order and Security Act for attempting to possess dangerous weapons and was sentenced to four years in jail. He was slapped with a further three years for attempting to buy dangerous weapons without end-user certificates.
